Truyard Terms and Conditions

Terms and Conditions constitute a contract formed between the customer “you”
and Outdoor Power Group “we”.
Please
read the following Terms and Conditions carefully before using this site
(truyard.com.au). By accessing or using this site you are accepting these Terms
and Conditions below, and agree to be bound by them.
Outdoor Power Group owns and operates this website, and reserves the right to amended or update these Terms and Conditions at any time. By continuing to use the website, you accept the Terms and Conditions as modified, and thus should regularly review the current terms.
Legal Capacity
You must be eighteen (18) years of age or older to purchase from this site. By placing an order on this website, you are accepting this agreement to form a legally binding contract, and acknowledge you are over the age of eighteen (18) years.
Pricing and Availability
All the
prices on this website are in AUD and GST is included, where applicable.
Prices on
the website exclude delivery costs.
Prices on
the website are subject to change without notice.
We
reserve the right to correct any errors published on the website.
The
availability of products shown on the website is subject to change without
notice. Products shown on the website are not necessarily available
immediately.
If you
have placed an order for a product which is not currently available, you will
be notified if it is on back-order, and if it does not become available within
a reasonable time-frame you will be notified and your order may be subsequently
cancelled. Payment for the order will then be refunded.
Any
accessories shown in the product images are not included in the price, unless it
is stated otherwise.
Order Acceptance and Billing
Representations
of the products for sale on truyard.com.au constitute an invitation to treat.
At the time of placing an order on the website, you are making an offer to
enter into an agreement to purchase the products contained in your order.
The order
is deemed to have been received upon you receiving a confirmation email to your
nominated email address.
It is the
responsibility of you to ensure all your details have been entered in
correctly.
When an
incorrect delivery address has been provided, we may charge you a redelivery
fee for each re-delivery attempt.
Outdoor
Power Group is not liable for delays in performing their obligations, if the
cause of the delay was outside of their reasonable control.
Payment
is processed immediately upon the order being confirmed.
Delivery
We will
supply to you the products shown in your order confirmation.
Costs
will be calculated depending on your delivery location and what you order, and reflected in
your
order.
We will
not be held liable for any loss or damage suffered by anyone as a result of
delays that are due to factors out of our control.
We are
not responsible for any additional costs that occur because of incorrect
delivery information, such as re-delivery costs.
Delivery
addresses must be within Australia, and we do not deliver to PO Boxes.
We
endeavour to deliver to all addresses, but if the address is not deliverable to
by our freight company, delivery will be made to your nearest depot that the
freight company deliver too.
For delivery, all orders are automatically specified to leave where safe, i.e. does not
require a signature on delivery.
We are
not responsible for the delivery time for products. Customers are required to
communicate with the courier nominated by Outdoor Power Group. (Outdoor Power
Group will not accept responsibility for delivery failures or delays, by the
third party delivery courier)
At the
time of placing your order via the website or when discussing your order with
Outdoor Power Group, you must make known any difficulties that may be involved
in the delivery. If you do not, and on arrival delivery is deemed to be more
difficult, you will be liable for any extra charges.
Refunds, Credits and Returns
Returns
and refunds will be handled as per our Refund Policy, with no exclusions,
restrictions or modifications of the consumer guarantees defined by Australian
Competition & Consumer Commission (ACCC).
Refunds
will be transferred into the account from which the purchase was made.
It is the
customer’s responsibility to ensure items being returned, are returned safely.
We take
no responsibility for any products lost in transit.
The
products must be (a) returned to us at your cost, or when the cost to you is
significant because of the nature of the failed consumer guarantee compliance,
or the size or height of the product, (b) we will collect the products at our
expense, within a reasonable time frame.
Warranties
The warranty for each product sold on the website, is specific to that product.
Privacy
By placing your order you agree that Outdoor Power Group may store, process and use data collected from your order for the purpose of processing your order.Disclaimer
Outdoor
Power Group aim to provide useful and accurate information, however errors may
sometimes occur and the information given on the site may be inaccurate or out
of date.
For loss
or damage, of any kind, that could occur as a result of use of the website,
Outdoor Power Group exclude liability to you or anyone else. This includes, but
is not limited to, website errors/incorrect information, personal or property
damage and the transmission of any bugs, viruses or harmful malware through the
website by a third party.
Intellectual Property
The
content, images or TruYard trademarks may not be used, published or reproduced.
This site
is operated from Western Australia, and thus the laws of the State of Western
Australia will govern the legal notices and conditions of use, without giving
effect to any principles or conflicts of laws.
